1. Acceptance of these Terms
These Terms of Service form a binding agreement between you and Darky Development when you access darkydev.net, request a quote, purchase or commission work, download software, use a Discord bot, join an operated community, receive support, or otherwise use a Darky Development service.
By using a service, you confirm that you have read and accepted these Terms. If you do not agree, do not purchase, download, install, invite, access, or use the applicable service.
2. Scope of services
These Terms apply to custom and premade Discord bots, Minecraft plugins and mods, server setups, network configuration, websites, Tebex storefront work, desktop tools, graphics, technical support, hosting assistance, digital files, consultations, community systems, and other products or services supplied under the Darky Development name.
A quotation, invoice, listing, project brief, product page, licence file, Discord ticket, or product-specific policy may contain additional terms. Product-specific terms control only where they clearly conflict with these general Terms.
3. Eligibility and authority
You must be legally capable of entering an agreement in your jurisdiction. If you act for a company, server, team, community, or another person, you confirm that you are authorized to bind that party and to provide all materials and access submitted for the project.
Minors must obtain permission from a parent or legal guardian before purchasing paid work or providing payment information, credentials, personal information, or access to third-party accounts.
4. Quotes, orders, and project formation
Prices shown publicly are estimates or starting prices unless expressly described as fixed. A project begins only after scope, price, payment requirements, and essential specifications are agreed through an accepted quote, invoice, ticket, message, or written project brief.
Requests outside the agreed scope are change requests and may require additional payment, revised delivery dates, or a separate order. Silence, informal discussion, or preliminary examples do not create an obligation to deliver unapproved work.
5. Customer responsibilities
- Provide accurate requirements, examples, content, credentials, server information, deadlines, and technical constraints.
- Respond within a reasonable time to questions, approvals, tests, and delivery requests.
- Maintain lawful rights to all logos, code, files, databases, media, text, plugins, configurations, accounts, and other materials supplied.
- Create backups before installation, migration, configuration changes, updates, or troubleshooting.
- Test delivered work in a safe environment before production use.
- Protect passwords, tokens, API keys, webhook URLs, hosting credentials, and administrator access.
Delays, defects, or losses caused by incomplete instructions, incompatible third-party software, unauthorized modifications, missing access, or inaccurate information are not the responsibility of Darky Development.
6. Payments, deposits, and taxes
Payment terms are stated in the applicable quote or invoice. A deposit or full payment may be required before work begins, before source files are released, or before final deployment. Unless otherwise stated, amounts are payable in the currency shown and exclude taxes, platform fees, conversion charges, and payment-provider fees.
You are responsible for charges imposed by your bank, payment provider, hosting company, marketplace, app store, Tebex, Discord, Modrinth, domain registrar, or other third party.
7. Refunds and cancellations
Digital products, downloadable files, licences, completed services, setup work, source code, and customized deliverables are generally non-refundable after delivery, access, download, installation, or substantial work has begun.
Before work begins, a cancellation may be eligible for a refund less non-refundable payment fees and any agreed administrative costs. After work begins, any refund is discretionary and may be reduced by the value of completed work, reserved time, purchased assets, hosting costs, or third-party expenses.
No refund is owed for buyer's remorse, changed plans, failure to read requirements, incompatible self-selected software, loss of account access, a platform ban, server inactivity, third-party service changes, or modifications made after delivery.
8. Chargebacks and payment disputes
Before filing a chargeback or payment dispute, you must make a reasonable attempt to resolve the issue through support. Fraudulent, abusive, or knowingly false disputes may result in suspension of services, revocation of licences, termination of support, and recovery of reasonable costs where permitted by law.
Nothing in this section limits rights that cannot legally be waived.
9. Delivery, testing, and acceptance
Delivery may occur through Discord, email, a repository, a hosting panel, a downloadable archive, a marketplace, a deployed website, or another agreed method. Estimated dates are targets rather than guarantees unless a written agreement states otherwise.
You must inspect and test deliverables promptly. Unless a different review period is agreed, material defects should be reported with reproducible details within seven days of delivery. Requests made later may be treated as maintenance or new work.
10. Revisions and support
Included revisions are limited to correcting work so that it substantially matches the agreed scope. New features, redesigns, changed preferences, new platform versions, altered server stacks, or expanded integrations are not defect corrections.
Support duration and response times vary by project. No continuous, emergency, twenty-four-hour, lifetime, or guaranteed update support is included unless expressly purchased or written into the order.
11. Software licences
Unless a separate licence states otherwise, paid premade products and custom deliverables are licensed to the purchasing customer for the agreed project, server, bot, website, or organization. Ownership of the underlying development methods, reusable libraries, frameworks, templates, utilities, and pre-existing code remains with Darky Development.
You may not resell, redistribute, leak, publish, sublicense, decompile for redistribution, remove licensing controls, share private builds, or falsely claim authorship without written permission. Open-source or public Modrinth releases remain governed by the licence displayed on their project page.
12. Custom work and intellectual property
Upon full payment, you receive the usage rights expressly included in the project agreement. Transfer of exclusive copyright or full source ownership occurs only when specifically agreed in writing.
Darky Development may retain generalized knowledge, non-confidential techniques, reusable components, and independently developed code. Unless confidentiality is agreed, completed public-facing work may be identified in a portfolio without exposing private credentials, private source code, customer data, or confidential business information.
13. Customer content and permissions
You retain ownership of content you provide. You grant Darky Development a limited licence to host, copy, modify, process, test, and display that content solely as needed to perform the requested work, provide support, secure the service, and comply with law.
You must not submit stolen code, pirated assets, malware, personal data obtained unlawfully, copyrighted material without permission, or content that violates a platform's rules.
14. Acceptable use
You may not use Darky Development services to facilitate malware, credential theft, token logging, unauthorized surveillance, raids, denial-of-service attacks, harassment, doxxing, fraud, impersonation, illegal gambling, unlawful sales, exploitation, copyright infringement, platform evasion, or unauthorized access to systems or accounts.
Tools described as scanners, analyzers, migration utilities, moderation systems, identity tools, or security tools may be used only on systems, servers, files, accounts, and data you own or are authorized to inspect.
15. Discord bots and communities
Bot features depend on Discord availability, permissions, intents, API limits, server configuration, roles, and administrator decisions. Commands, stored settings, premium access, moderation records, and integrations may stop working if permissions are removed, Discord changes its API, the bot is removed, or a required third-party service fails.
Community access is a privilege, not a purchased ownership right. Users may be muted, restricted, removed, or banned for abuse, fraud, evasion, harassment, harmful content, false reports, chargeback abuse, or violations of community rules.
16. Minecraft mods, plugins, and server work
Minecraft software may depend on specific game versions, loaders, APIs, Java versions, server software, mappings, mods, plugins, databases, or hosting environments. Compatibility is limited to the versions and platforms stated in the listing or project scope.
Updates to Minecraft, Fabric, Paper, Folia, Velocity, Mojang/Microsoft services, server hosts, anticheats, or third-party plugins may require paid updates or may make a feature temporarily or permanently unavailable.
Client-side cosmetic or identity tools do not grant permission to deceive users, evade moderation, impersonate another person, or violate server rules.
17. Websites, stores, domains, and hosting
Website work may depend on Vercel, Tebex, Formspree, DNS providers, domain registrars, CDNs, payment processors, analytics providers, and hosting companies. The customer is responsible for maintaining accounts, subscriptions, billing, domain renewals, store compliance, product descriptions, taxes, refund obligations, and credentials unless a written agreement states otherwise.
Darky Development does not guarantee search rankings, revenue, sales, uptime, conversion rates, accessibility certification, legal compliance, or continued compatibility with third-party themes and integrations unless that specific service is included.
18. DonutStats and product-specific services
Darky's DonutStats is operated through its dedicated domain at stats.darkydev.net. Bot-specific commands, premium features, usage limits, data practices, and notices may be stated there or inside Discord.
Game statistics, market information, auction data, alerts, estimates, and automated analysis may be incomplete, delayed, unavailable, or inaccurate. They are informational tools and are not guarantees of value, profit, player conduct, or transaction safety.
19. Scam Reports project
Scam Reports is a community safety tool and is not an official DonutSMP, Mojang, Microsoft, or Modrinth service. A report or warning is not a legal finding and does not guarantee that a player has or has not engaged in misconduct.
Users submitting reports must provide relevant, authentic evidence and must not submit fabricated claims, harassment, private personal information, or malicious reports. Decisions may be reviewed, changed, appealed, or removed as additional evidence becomes available.
20. Third-party services
Links and integrations may connect to Discord, Modrinth, Minecraft, Microsoft, Mojang, Tebex, Vercel, GitHub, payment providers, hosting companies, social platforms, and other independent services. Their availability, content, rules, security, payments, and privacy practices are controlled by those providers.
Darky Development is not responsible for third-party outages, bans, policy changes, data loss, account closures, fees, moderation, or discontinuation.
21. Security and credentials
Customers should provide the minimum access required, use temporary credentials where possible, enable multi-factor authentication, and rotate passwords, tokens, keys, and webhooks after project completion.
No system can be guaranteed completely secure. Darky Development is not responsible for compromises caused by reused passwords, exposed tokens, malicious third-party plugins, customer devices, shared accounts, weak permissions, or failure to follow security instructions.
22. Backups and data loss
You are responsible for maintaining current backups of worlds, databases, configuration, websites, repositories, bot data, and production systems. Darky Development may create temporary backups during work but does not promise permanent backup storage unless separately contracted.
23. Confidentiality
Non-public project information identified as confidential will be handled with reasonable care and used only for delivery, support, security, payment, or legal purposes. Confidentiality does not cover information already public, independently developed, lawfully received from another source, or required to be disclosed by law.
24. Suspension and termination
Access, licences, support, communities, premium features, or active work may be suspended or terminated for non-payment, fraud, abusive conduct, security risk, unlawful use, licence violation, unauthorized redistribution, repeated policy violations, or material breach.
Termination does not erase payment obligations, confidentiality duties, intellectual-property restrictions, dispute provisions, or other clauses intended to survive termination.
25. Disclaimer of warranties
To the maximum extent permitted by law, services and digital products are provided on an "as available" and "as is" basis. No warranty is made that a service will be uninterrupted, error-free, permanently compatible, secure against every threat, accepted by every platform, or suitable for every purpose.
Any mandatory warranties or consumer rights that cannot legally be excluded remain unaffected.
26. Limitation of liability
To the maximum extent permitted by law, Darky Development will not be liable for indirect, incidental, special, punitive, exemplary, or consequential loss, including lost profits, lost revenue, lost data, lost players, reputational harm, business interruption, platform penalties, or third-party claims.
Where liability cannot be excluded, total aggregate liability relating to a specific order or service will not exceed the amount actually paid for that order or service during the six months preceding the event giving rise to the claim, except where a different limitation is required by law.
27. Indemnity
To the extent permitted by law, you agree to defend and hold Darky Development harmless from third-party claims arising from materials you supply, unlawful use, infringement, unauthorized access, misrepresentation of authority, violation of platform rules, or breach of these Terms.
28. Service changes and discontinuation
Features, pricing, availability, commands, supported platforms, integrations, and public products may be changed, limited, replaced, or discontinued. Reasonable efforts may be made to announce material changes, but emergency security or platform changes may occur without advance notice.
29. Governing law and disputes
Unless mandatory consumer law requires otherwise, these Terms are governed by the laws of Ontario and the applicable federal laws of Canada. The parties should first attempt in good faith to resolve disputes through written support communication before starting formal proceedings.
Any court proceeding that may lawfully be assigned to a forum will be brought in a court of competent jurisdiction in Ontario, Canada.
30. Changes to these Terms
These Terms may be updated to reflect new products, providers, security needs, business practices, or legal requirements. The current version will be posted on this page with an updated date. Continued use after an update constitutes acceptance where permitted by law.
31. General provisions
If any provision is unenforceable, the remaining provisions continue in effect. Failure to enforce a provision is not a waiver. You may not assign your agreement without written permission. Darky Development may assign rights and obligations as part of a business transfer, restructuring, or service transition.
